Miriam Santiago is Real Culprit

An alliance of 13 militant girls's groups have voiced'rage' over convicted rapist Francisco Juan'Paco' Larraaga's impending transfer to a penal facility in Spain under the RP-Spain Transfer of prisoners Agreement that was approved just this month.

In their letter broadcast in the Philippine Daily Inquirer, the women's groups asked why this TSPA with Spain was prioritized by the govt. even though there are more Asian and Middle Eastern nations where a lot more Filipino employees are now incarcerated.

Comprising this league are the Coalition Against Trafficking in Women-Asia Pacific ( CATW-AP ), World March of Women-Pilipinas, Alliance of Progressive labor ( APL ) -Women, WomenLEAD, ECPAT-Philippines, Kaisa-ka, WomanHealth, Philippines, Bagong Kamalayan Collective Inc. ( BKCI ), Sarilaya, Welga ng Kababaihan, Kababaihan Laban sa Karahasan Foundation, Task Force Subic Rape ( TFSR ) and Pambansang Koalisyon ng Kababaihan sa Kanayunan ( PKKK ).

These groups pointed out that not many Filipinos are aware about the RP-Spain TSPA which was supported by a domestic law that became valuable in January 2008.

The local law, according to the girls's groups in their letter, was authored by Cebu representative Antonio Cuenco. They have blasted the Cebuano connection here as the Larraagas also hail from Cebu.

'While the supporting bill was being deliberated in the Congress, the Chiong family [has already] expressed its objection to the TSPA with Spain,' the ladies's groups added.

They, moreover, are interrogating what significant benefits will the country gain from the RP-Spain prisoner swap treaty given the incontrovertible fact that there are only 7 Filipinos locked up in that country, relatively smaller than those of other nations.

The groups cited that there are Asian and Middle Eastern states where more Filipino workers are detained, with Malaysia posting the largest number of 1,600.

Following Malaysia are : Japan with 734 Filipino captives, of which 130 are in Osaka, Qatar, with 554, the U. S. with 406, Abu Dhabi with 198, Saudi Arabia ( in Jeddah alone ) with 161, Kuwait with 128 and hong kong with 127.

These groups likewise reminded the Filipinos of other convicted rapists in the past similar to Larraaga like Romeo Jalosjos, Claudio Teehankee Jr. Who were granted executive pardon.

These ladies's groups have not been able to see , however , that if there's anyone to blame other Rep. Cuenco of Cebu, it must be the lead proponent of that little-known RP-Spain TSPA-Senator Miriam Defensor Santiago, who chairs the Senate foreign relations board.

Unknown to many, Santiago, as committee chairperson, was the one who bankrolled and protected the resolution ratifying the concord in the higher chamber. This prisoner swap treaty was signed in Madrid on May eighteen, 2007, and, with the assistance of the woman senator, was ratified by the Senate on November. Twenty-six, 2007.

In Santiago's blog entry at miriam.com.ph on Nov 16 2007, she said:'Nag-public hearing kami ngayong araw, at sa Lunes ay iso-sponsor ko na sa Senate floor [ang treaty], para pagkatapos ng mga debate ay maghihintay na lang ng tatlong araw para maaprubahan na for third reading sa Senado.'

When asked who need to initiate the request for transfer between the sentenced person and the governments of Spain and the Philippines, Santiago said that,'it is essential the prisoner must consent whether or not he instituted it.'

She further explained [*CO]'Spain can initiate the request as long as the prisoner later on consents as we are talking of starting the method. In any event, even if the process has started, if the captive does not give his written consent, then the rest that happened before will become invalid.'

The senator, moreover, was the brains behind the joint resolution filed last year that sanctioned the Department of Justice ( DOJ ) to distibute implementing rules and rules with regard to the accord.

Santiago signed on June 2, 2008 Senate Joint Resolution no. 7 entitled'Joint Resolution Authorizing the Department of Justice to give out the Implementing Rules and rules on the treaty on the transference of Sentenced people between the Republic of the Philippines and the dominion of Spain and taking Funds for its Implementation.'

So if there is anyone who should be on top of the hit list of these militant ladies's group, it has to be Senator Miriam Santiago.
