My sister is a U.S. immigrant visa holder, (green card). He is currently in the Philippines today?
Pregnant ... He is planning to provide Phil birth. But what he is worried that he might stay six more months in the Philippines for he is only allowed to stay outside the U.S. for 6 months for He was still holding an immigrant visa .. Can he make such a request of something or the embassy?
He will be outside the U.S. for not more than a year on his green card. 6 months is correct. But if he wants to become a U.S. citizen in the future, he needs to return to more less than 6 months. If he is out for 6 months or more, he has to restart his time as a residence for naturalization purposes. His green card probably not in danger if he is not between 6 months and one year. It's just that he has to wait much longer to become a citizen. Also, there called returning resident visa can he apply for the U.S. consulate in the Philippines to keep its status. He should call the consulate and ask about of these options. If her husband is not a U.S. citizen, the baby does not become a U.S. citizen and either it is difficult to bring him to the U.S..
